Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Fish On! mobile application and related services (collectively, the "Services") operated by Kandr LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Eligibility

You must be at least 13 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Services.

3. Account Registration

You may use certain features of the Services without creating an account. To access features such as catch logging, AI fish identification, and subscriptions, you must create an account using Sign in with Apple, Google, or email one-time passcode. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates applicable laws or regulations
  • Upload or transmit content that is illegal, harmful, threatening, abusive, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Services or related systems
  • Interfere with or disrupt the Services or servers connected to the Services
  • Use automated means (bots, scrapers, etc.) to access the Services without our written permission
  • Reverse-engineer, decompile, or disassemble any part of the Services
  • Use the AI identification feature to submit content unrelated to fish identification

5. User Content

You retain ownership of the content you submit through the Services, including photos, catch records, and notes ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process your User Content solely for the purpose of providing and improving the Services. We do not use your photos to train AI models.

Anonymized, location-fuzzed catch data may be displayed on the community map visible to other users. Your exact fishing locations are never shared.

6. AI Fish Identification

The AI identification feature is provided for informational purposes only. Species identifications are generated by a third-party AI model (Google Gemini Vision) and may not always be accurate. We make no guarantees regarding the accuracy, completeness, or reliability of AI-generated results. You should not rely solely on AI identification for decisions related to fish consumption, regulatory compliance, or safety.

7. Subscriptions & Payments

Certain features of the Services require a paid subscription. Subscriptions are billed through Apple's In-App Purchase system. By subscribing, you agree to Apple's terms for in-app purchases. Subscription pricing and terms are displayed in the app at the time of purchase.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage or cancel your subscription through your Apple ID account settings
  • Refunds are handled by Apple in accordance with their refund policies
  • We reserve the right to change subscription pricing with reasonable notice

8. Intellectual Property

The Services, including all software, designs, text, graphics, logos, and other content (excluding User Content), are owned by Kandr LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the practices described in the Privacy Policy.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not responsible for any decisions you make based on information provided by the Services, including AI identification results, weather data, or community map data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANDOR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kandr LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. You may stop using the Services and delete your account at any time through the app. Upon termination, your right to use the Services ceases immediately, but provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected on this page with an updated "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.
